These Terms and Conditions govern access to sunsetceramics.org and purchases made from Sunset Ceramics through the website. They explain how orders, payments, shipping, returns, refunds, and use of the website are handled. By using the website or placing an order, you agree to these Terms and Conditions and the policies referenced in them.

Please read these terms before purchasing. If you do not agree to them, do not use the website or submit an order. Nothing in these terms limits a consumer right or remedy that cannot legally be waived.

1. Agreement and Eligibility

These terms form an agreement between you and Sunset Ceramics. You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order. If you purchase on behalf of an organization, you represent that you have authority to bind that organization.

2. Handmade Products

Sunset Ceramics creates handmade products. Small differences in color, glaze, texture, shape, pattern, weight, and dimensions are normal and make each piece unique. These natural variations are not defects.

We make reasonable efforts to display products accurately, but screens, lighting, photography, and production variation may affect how colors and details appear. Measurements and capacities are approximate unless a listing states otherwise. A product listing will indicate whether the exact photographed piece or a representative made-to-order piece will be supplied.

Food safety, microwave safety, dishwasher safety, oven safety, and other functional qualities apply only when expressly stated in the product listing or care instructions. Do not use a chipped, cracked, or otherwise damaged ceramic item for food or drink.

3. Orders and Acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. We may decline or cancel an order because of inventory errors, incorrect pricing, payment problems, suspected fraud, shipping restrictions, or other reasonable business concerns. If we cancel an order after payment is captured, we will refund the canceled amount to the original payment method.

Many items are one of a kind and may become unavailable. Items placed in a cart are not reserved until checkout is completed. Contact us promptly to request a change or cancellation. We cannot guarantee changes or cancellations after fulfillment begins, an order ships, or work begins on a custom item.

4. Prices Taxes and Promotions

Prices are shown in United States dollars unless stated otherwise and may change without notice. The price charged is the price displayed when the order is submitted, except when an obvious pricing or technical error occurs.

Applicable taxes are calculated according to the information supplied at checkout and legal requirements. You are responsible for providing an accurate delivery and billing location. Discounts, coupons, and promotions are subject to their stated conditions, expiration dates, and product exclusions and may not be combined unless expressly allowed.

5. Payment

Payments are processed by the payment methods and third-party providers shown at checkout. By providing payment information, you represent that you are authorized to use the selected method and authorize the charges shown in the order total. We do not guarantee that every payment method will always be available.

You are responsible for accurate billing information. If a payment is declined, reversed, disputed, or identified as unauthorized, we may suspend fulfillment or cancel the order. Payment providers may apply their own terms and privacy practices.

6. Customer Accounts

You may be permitted to check out as a guest or create an account. You are responsible for keeping account credentials confidential and for activity performed through your account. Notify Sunset Ceramics promptly through the website contact page if you suspect unauthorized access. We may suspend or close an account used fraudulently, unlawfully, or in violation of these terms.

7. Shipping and Delivery

Available destinations, carriers, service levels, and charges are displayed during checkout. Processing and delivery dates are estimates, not guarantees. Handmade and made-to-order products may require additional production time disclosed in the product listing.

You are responsible for entering a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address, refusal of delivery, or failure to collect a package may be charged to you to the extent permitted by law. Contact us immediately if an address must be corrected; an address cannot always be changed after fulfillment begins.

Title and risk of loss pass as provided by applicable law. Nothing in this section removes any responsibility Sunset Ceramics has for delivering conforming goods or any nonwaivable right relating to lost or damaged merchandise.

8. Optional Shipping Insurance and Protection

Customers may be offered optional shipping insurance or shipping protection through our preferred shipping provider at checkout. The provider’s terms govern covered events, exclusions, evidence requirements, filing deadlines, compensation limits, and claim decisions. The fee for optional protection is nonrefundable after the shipment has been tendered to the carrier, except where law requires otherwise.

Purchasing protection does not eliminate the customer’s responsibility for return-shipping costs on an ordinary return. If protection is declined, any recovery for loss, theft, or transit damage may be limited to the carrier’s standard liability, the remedies offered by Sunset Ceramics, and the remedies required by law. Declining optional protection does not waive a right that cannot legally be waived.

9. Returns

We accept return requests made within 14 calendar days after confirmed delivery. To request a return, contact Sunset Ceramics through the website contact page before shipping the item. Include the order number, the item being returned, and the reason for the return. A return sent without prior authorization may not be accepted.

To qualify for an ordinary return, the item must be:

• Unused and in its original condition

• Free from damage, stains, or signs of use

• Returned in its original packaging or packaging that provides equivalent protection

• Shipped using a trackable service

Unless an item arrived damaged, defective, or incorrect, the customer is responsible for all return-shipping costs. We strongly recommend adequate carrier insurance for a return shipment. Sunset Ceramics is not responsible for returned merchandise that is lost or damaged while being shipped back to us, except to the extent required by law.

10. Refunds

We will inspect an approved return and notify you whether the refund has been accepted. An approved refund will be issued to the original payment method and will include the amount paid for the returned item and any associated tax required to be refunded by law.

Except where law requires otherwise, original shipping charges, expedited shipping charges, optional shipping insurance or shipping protection fees, and return-shipping costs are nonrefundable.

If a returned item arrives used, damaged, incomplete, or inadequately packaged, we may reduce or deny the refund to the extent permitted by law. After approval, allow 5 to 10 business days for the refund to appear. Actual timing is controlled by the bank or payment provider.

11. Damaged Defective or Incorrect Items

Inspect an order promptly after delivery. If an item arrives damaged, defective, or incorrect, contact us within 48 hours after delivery through the website contact page. Provide the order number and clear photographs of the item, shipping box, packing materials, and shipping label.

Keep the product, packaging, and packing materials until we confirm that they may be discarded because they may be required for a carrier or protection claim. After reviewing the claim, we may offer a replacement, repair, store credit, or refund, depending on availability, the circumstances, and applicable law.

We will provide instructions if a confirmed damaged, defective, or incorrect item must be returned. The customer will not be required to pay return shipping for such an item. Failure to report within 48 hours may affect a carrier or insurance claim, but it does not eliminate any nonwaivable legal right.

12. Lost or Stolen Packages

If tracking indicates that a package is delayed or lost, contact us so that we can assist with a carrier investigation. If tracking shows delivery but the package cannot be found, check with household members, neighbors, the carrier, and the delivery location before submitting a claim. Claims involving protected shipments are handled according to the protection provider’s terms.

13. Nonreturnable Items

The following items cannot be returned unless they arrive damaged, defective, or incorrect:

• Custom or personalized pieces

• Made-to-order items after production has begun

• Gift cards

• Items clearly marked Final Sale before purchase

• Items that have been used

• Items returned after the return period

• Items damaged after delivery

14. Custom and Made to Order Work

A custom or made-to-order listing may specify design choices, estimated production time, deposit requirements, approval steps, and cancellation terms. You are responsible for reviewing and approving submitted specifications. Natural ceramic and glaze variation remains possible even when a reference image or color preference is provided.

A custom order generally cannot be canceled or returned after production begins. A deposit or the portion of the price attributable to completed work may be nonrefundable only when that condition was disclosed before purchase and is permitted by law.

15. Exchanges

Because many Sunset Ceramics products are one of a kind, direct exchanges may not be available. If an exchange is approved, the customer is responsible for returning the original item and paying any price difference and new shipping charges, unless the original item arrived damaged, defective, or incorrect.

16. Product Care and Safe Use

Follow all care and use information supplied with a product or included in its listing. Ceramic products are breakable and may have sharp edges when damaged. Stop using an item that becomes chipped, cracked, or unstable. Do not expose an item to a microwave, dishwasher, oven, open flame, thermal shock, or food contact unless the listing expressly states that the use is appropriate.

17. Website Use

You may use the website only for lawful personal or commercial purchasing and ordinary informational purposes. You may not interfere with the website, attempt unauthorized access, introduce malicious code, scrape or copy content through automated means without permission, misuse checkout or promotions, impersonate another person, or use the website in a way that violates law or the rights of others.

We may limit or terminate access when reasonably necessary to protect the website, customers, payment systems, or Sunset Ceramics.

18. Intellectual Property

The website and its original text, product photographs, artwork, designs, logos, graphics, and other content are owned by or licensed to Sunset Ceramics and are protected by applicable intellectual property laws. Purchasing a ceramic product does not transfer copyright or other intellectual property rights in the design, photographs, or related content. You may not reproduce, distribute, sell, or create commercial derivative works from website content without written permission.

19. Reviews and Submitted Content

If you submit a review, photograph, comment, or other content, you confirm that you have the right to submit it and that it is truthful, lawful, and does not violate another person’s rights. You grant Sunset Ceramics a nonexclusive, worldwide, royalty-free license to display, reproduce, and adapt that submitted content for operating and promoting the business. You may ask us to stop future use, although prior lawful uses may not be fully retractable.

We may remove submitted content that is unlawful, abusive, misleading, unrelated, contains private information, or violates these terms. We do not promise to publish every review.

20. Third Party Services and Links

The website may use or link to services operated by payment processors, carriers, shipping-protection providers, social networks, analytics providers, and other third parties. Their services are governed by their own terms and privacy policies. Sunset Ceramics is not responsible for third-party websites or services outside its reasonable control, but this does not limit responsibility imposed on us by law.

21. Privacy and Electronic Communications

Our Privacy Policy explains how personal information is collected, used, and disclosed. By using the website, you acknowledge the Privacy Policy. Transactional communications, including order confirmations, security notices, shipping updates, and customer-service messages, may be sent electronically. Marketing messages will be handled according to the choices and rights described in the Privacy Policy and applicable law.

22. Website Availability and Disclaimers

We work to keep the website accurate and available, but the website may occasionally contain errors, become unavailable, or require maintenance. To the fullest extent permitted by law, the website is provided as available without guarantees that access will be uninterrupted, error free, or secure.

Any warranty disclaimer in these terms applies only to the extent permitted by law. It does not exclude an express product promise made in a listing or a consumer warranty or remedy that cannot legally be waived.

23. Limitation of Liability

To the fullest extent permitted by law, Sunset Ceramics will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website or a purchase. For a claim connected to a particular order, our aggregate liability will not exceed the amount paid for the product giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, gross negligence where applicable, or personal injury caused by conduct for which limitation is prohibited.

24. Events Beyond Reasonable Control

Sunset Ceramics is not responsible for delay or failure caused by events beyond its reasonable control, including severe weather, natural disasters, fire, labor disruption, carrier interruption, utility or internet failure, governmental action, supply shortages, or similar events. We will make reasonable efforts to communicate material delays and fulfill or refund affected orders as appropriate.

25. Governing Law and Disputes

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except when another jurisdiction’s consumer-protection law must apply. Before filing a claim, you and Sunset Ceramics agree to make a good-faith effort to resolve the issue by contacting the other party and allowing 30 days for a response, unless urgent relief or a legal deadline makes that impractical.

Any court proceeding relating to these terms or a website purchase must be brought in a court with jurisdiction serving the county in which Sunset Ceramics maintains its principal place of business, unless applicable law permits or requires a different location. Either party may bring an eligible matter in small claims court.

26 Changes to These Terms

We may update these terms from time to time. The effective date at the top identifies the current version. Changes apply prospectively when posted and do not retroactively alter an order already accepted unless required by law or agreed by the customer.

27. Severability Waiver and Assignment

If a provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign rights or obligations under these terms without written consent. Sunset Ceramics may assign these terms in connection with a sale, reorganization, or transfer of the business, subject to applicable law.

28. Entire Agreement and Order of Terms

These Terms and Conditions, the Privacy Policy, any product-specific terms, and the order confirmation form the agreement governing a website purchase. If terms conflict, product-specific terms disclosed before purchase control for that product, followed by the order confirmation, these Terms and Conditions, and then general website policies.
